Important: These Terms of Service ("Terms") govern your use of the GPSnap website and services. By using GPSnap, you acknowledge that you have read, understood, and agree to be bound by these Terms. If these Terms are not acceptable to you, we respectfully request that you discontinue use of our Service.

1. Acceptance of Terms

By accessing and using GPSnap ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If these Terms of Service are not acceptable to you, we kindly ask that you refrain from using our Service. GPSnap is provided by GPSnap Team ("we," "us," or "our") and these terms govern your use of our website and services available at www.gpsnap.com and related domains. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

GPSnap provides web-based tools for GPS-enabled image capture and image comparison. The Service allows users to capture photographs with GPS location data overlays and to compare images using various viewing modes. All image processing occurs locally in your web browser. We do not upload, store, or have access to any images you capture or compare using our Service. The Service is provided free of charge for personal and commercial use. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We make no guarantee of Service availability or uptime.

3. User Responsibilities

You are solely responsible for all images captured, compared, or downloaded using our Service. You must have all necessary rights, permissions, and legal authority to photograph locations and subjects you document using our Service. You agree not to use the Service for any unlawful purpose or in violation of any local, state, national, or international law. You are responsible for ensuring your use of GPS location data complies with applicable privacy laws and regulations. You agree not to photograph private property without proper authorization, or to use the Service to violate privacy rights of individuals. You are responsible for the accuracy and appropriateness of any documentation you create using our Service.

4. Privacy and Data Collection

GPSnap operates on a privacy-first principle. All image capture and processing occurs locally in your web browser using client-side JavaScript. We do not upload, store, or have access to any images you capture or compare. GPS location data is obtained through your browser's Geolocation API and processed entirely on your device. Location data is never transmitted to our servers. We do not collect personal information, user accounts are not required, and we do not use tracking cookies for data collection purposes. Optional address reverse geocoding uses OpenStreetMap Nominatim API, which receives GPS coordinates anonymously without user identification. Our contact form stores submitted information (name, email, message) in Supabase database for communication purposes only. 5. Intellectual Property Rights

You retain all ownership rights to images you capture or upload to our Service. We claim no intellectual property rights over images you create using GPSnap. The GPSnap website, design, text, graphics, logos, and underlying software code are owned by GPSnap Team and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software without our express written permission. You may not reverse engineer, decompile, or attempt to extract the source code of our Service. The GPSnap name and logo are trademarks of GPSnap Team and may not be used without permission.

6. Acceptable Use Policy

You agree to use GPSnap only for lawful purposes and in accordance with these Terms. Prohibited uses include but are not limited to: using the Service to violate any laws or regulations; photographing private property without authorization; violating privacy rights or taking invasive photos of individuals; capturing images for fraudulent purposes including insurance fraud or false documentation; using the Service to harass, abuse, or harm others; attempting to interfere with, disrupt, or create undue burden on the Service or servers; attempting to gain unauthorized access to any portion of the Service; using automated systems or software to extract data from the Service; using the Service for any commercial surveillance or unlawful monitoring; and misrepresenting the source, origin, or authenticity of images created with our Service.

7. GPS Accuracy and Reliability

GPS location data provided by our Service depends on your device's GPS capabilities and environmental factors. We make no guarantees about GPS accuracy, which typically ranges from 5-50 meters depending on device, satellite visibility, and environmental conditions. GPS data should not be relied upon for surveying, legal boundary determination, or applications requiring precision beyond consumer GPS capabilities. Timestamps are based on your device's clock and GPS time signals. We are not responsible for inaccurate location or timing data resulting from device errors, GPS signal issues, or environmental interference. Users are responsible for verifying GPS accuracy is sufficient for their intended use. GPS overlays are provided "as is" without warranty of any kind regarding accuracy or reliability.

8. Third-Party Services

Our Service integrates with certain third-party services: OpenStreetMap Nominatim API for address reverse geocoding, Google reCAPTCHA for form protection, Google Analytics for traffic analysis, and Google AdSense for advertising. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for third-party service availability, accuracy, or practices. Third-party service failures or changes may affect Service functionality. We reserve the right to change, add, or remove third-party service integrations at any time. Links to external websites are provided for convenience and do not constitute endorsement. We are not responsible for content, accuracy, or practices of linked external sites.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any GPS data, location information, or results obtained through the Service. We do not warrant that defects will be corrected or that the Service is free of viruses or other harmful components. We make no warranties about the suitability of the Service for any particular purpose, including professional, commercial, or legal applications. Your use of the Service is at your sole risk. Some jurisdictions do not allow exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GPSnap Team SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR IMAGES OR DATA; (C) ANY INTERRUPTION OR CESSATION OF THE SERVICE; (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR GPS DATA; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless GPSnap Team, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from: any violation of these Terms of Service by you; any activity related to your use of the Service, including negligent or wrongful conduct; your violation of any law, regulation, or rights of third parties; any images you capture, create, or distribute using the Service; any claims that your use of the Service caused damage to a third party; and any misuse of GPS data or location information obtained through the Service. This indemnification obligation will survive termination of these Terms and your use of the Service.

12. Legal Use and Compliance

You agree to use GPSnap in compliance with all applicable laws and regulations. You are responsible for understanding and complying with laws governing photography, privacy, data protection, and GPS data in your jurisdiction. In some jurisdictions, photographing certain locations (government facilities, private property, individuals) may require permission or be prohibited. GPS data may be subject to data protection laws like GDPR. You are responsible for obtaining necessary consents, permissions, and legal authorizations for your use of the Service. If you use GPSnap for professional or commercial purposes, you are responsible for ensuring compliance with industry-specific regulations and standards. We make no representations that the Service is appropriate or available for use in all locations. Using the Service from jurisdictions where its content is illegal is prohibited.

13. Camera and Location Permissions

The Service requires camera and location permissions from your web browser to function. You grant these permissions directly to your browser, not to GPSnap. We cannot access your camera or location without explicit browser permission granted by you. You can revoke these permissions at any time through your browser settings. If you deny permissions, certain Service features will be unavailable. Camera and location access is used solely for Service functionality - capturing images and obtaining GPS coordinates. Permissions are requested only when needed for Service features you choose to use. We do not store or record camera feeds or location histories. All camera and location access occurs within your browser and device, following browser security protocols.

14. User-Generated Content

While we do not store images you create, if you share or distribute GPS-tagged images created with our Service, you are solely responsible for that content. You represent and warrant that you have all necessary rights to share any images you distribute. You are responsible for any consequences of sharing GPS-tagged images, including privacy implications of revealing location data. We are not responsible for how others use, distribute, or misuse images you share. If you submit content to us through contact forms or other communications, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for Service operation and improvement purposes. We reserve the right to remove or refuse any content that violates these Terms or applicable law.

15. Modification of Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may impose limits on certain features or restrict access to parts or all of the Service without notice or liability. We may update or change the Service to reflect changes in technology, user needs, business priorities, or legal requirements. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service. It is your responsibility to ensure you have downloaded and saved any images you wish to keep, as we do not store images and cannot recover them if Service features change or become unavailable.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Since we do not maintain user accounts, termination may involve blocking access from your IP address or device. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability. You may terminate your use of the Service at any time by simply discontinuing access. There are no cancellation procedures required as we do not maintain user accounts or subscriptions.

17. Advertising

GPSnap displays advertising through Google AdSense to support free Service provision. We do not control the content of advertisements displayed. Advertisements are provided by Google and subject to Google's advertising policies. We are not responsible for the accuracy, content, or practices of advertisers. Your interactions with advertisers, including purchase of goods or services, are solely between you and the advertiser. We shall not be liable for any loss or damage incurred as result of any dealings with advertisers or the presence of advertisers on the Service. We do not endorse or recommend products or services advertised on our Service. You agree that advertising is necessary to provide the Service free of charge.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GPSnap Team operates, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to your access to or use of the Service shall be instituted in courts of competent jurisdiction in that location. You agree to submit to the jurisdiction of such courts and waive any objection to venue in such courts. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of GPSnap Team to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and GPSnap Team concerning the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us. These Terms may not be amended or modified except by posting revised Terms on our website. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. If any provision of these Terms is held invalid or unenforceable, that provision shall be construed consistent with applicable law and the remaining provisions shall remain in full force and effect.
